ESOTIQ ONLINE SHOP TERMS AND CONDITIONS
I. INFORMATION ABOUT THE ENTREPRENEUR
1. These Terms and Conditions set out the general terms and conditions of use of the online shop located at: www.esotiq.com, also available via the Esotiq mobile app, hereinafter referred to as the ESOTIQ Online Shop, by entities, including consumers, purchasing Goods via the ESOTIQ Online Shop.
2. The ESOTIQ Online Store, operating at www.esotiq.com, also available via the Esotiq mobile application, is operated by: ESOTIQ & HENDERSON S.A. with its registered office in Gdańsk, address: ul. Budowlanych 31C, 80-298 Gdańsk, a company entered in the Register of Entrepreneurs of the National Court Register by the District Court Gdańsk-Północ in Gdańsk, 7th Commercial Division of the National Court Register, under KRS number 0000370553. Share capital PLN 223,350.00, paid in full. Tax Identification Number (NIP): 583-311-72-20, National Business Registry Number (REGON): 221133543.
II. DEFINITIONS
The terms used in the Regulations shall have the following meanings:
1. Esotiq - ESOTIQ & HENDERSON S.A. with its registered office in Gdańsk, address: ul. Budowlanych 31C, 80-298 Gdańsk, entered in the Register of Entrepreneurs of the National Court Register by the District Court Gdańsk-Północ in Gdańsk, 7th Commercial Division of the National Court Register, under KRS number 0000370553. Share capital: PLN 223,350.00 paid in full, Tax Identification Number (NIP): 583-311-72-20, National Business Registry Number (REGON): 221133543.
2. Online Store – an organised IT platform for the presentation and sale of Goods operated by Esotiq via the website www.esotiq.com and the Esotiq mobile application.
3. Customer – an entity, including a consumer, purchasing Goods through the Online Store.
4. Goods – products presented as intended for sale in the Online Store.
5. Terms and Conditions – these Terms and Conditions.
6. Order – an offer to purchase a specifically designated Goods at the price displayed in the Online Store, made by the Customer to Esotiq in accordance with the Terms and Conditions.
7. Customer Account – an account in the Online Store enabling the placement and execution of Orders, as well as having other functionalities described in the Terms and Conditions, containing the Customer's personal data along with data on previous transactions, the status of the currently placed order, stored in the Esotiq IT system, access to which is protected by a login and password created by the Customer during registration. Access to the Customer Account is possible via the website www.esotiq.com and the Esotiq mobile application.
8. Esotiq mobile application – software (mobile application) made available by Esotiq to the Customer, intended for installation on the Customer's mobile device and allowing, in particular, the use of the Online Store without the need to launch a browser.
III. GENERAL PROVISIONS
1. ESOTIQ, through the Online Store, presents marked Goods together with the unit price of each of them.
2. Information about Goods intended for sale placed in the Online Store does not constitute an offer within the meaning of Article 66§1 of the Civil Code, but a price list and an invitation for the Consumer to place an Order in accordance with the unit price of the Goods and the terms and conditions of the Regulations.
3. The Company uses default sorting of products within the product list, which adjusts the order in which they are displayed on the Esotiq.com website. On the Esotiq.com website, in addition to the default sorting, the Customer can choose the following types of sorting within the product list:
a. Price: from lowest. Takes into account the following criteria in the following order: lowest product price
b. Price: from highest. Takes into account the following criteria in the following order: highest product price
c. New products. Takes into account the following criteria in the following order: new products recently added to Esotiq.com
d. Sale. Takes into account the following criteria in the following order: discounted products available on Esotiq.com
4. The sale and delivery of Goods through the Online Shop covers only the territory of the Republic of Poland.
5. The condition for using the Online Store is to read and accept these Terms and Conditions.
6. Upon receiving an Order, Esotiq acts in the belief that:
a. the Customer has the required legal capacity to perform the legal action they are undertaking;
b. the data and information provided by the Customer to Esotiq are true.
7. Customers may contact the Online Store at the following e-mail address: bok@esotiq.com
8. Customers may contact the Online Store in matters related to the operation of the Esotiq mobile application at the following e-mail address: bok@esotiq.com
9. In order to use the Online Store properly, the user (Customer) should have computer hardware and software that meets the following minimum requirements: (a) a computer, laptop or other multimedia device with Internet access (in the case of the Esotiq Mobile Application - a mobile device); (b) access to e-mail; (c) web browser: Mozilla Firefox version 55.0 and above, or Internet Explorer version 11.0 and above, Opera version 52.0 and above, Google Chrome version 59.0 and above, Safari version 11.0 and above; (d) recommended minimum screen resolution: 1280x800; (e) enabling cookies and JavaScript in the web browser; (f) for the Esotiq mobile application – mobile device operating system: Android 5.0 or higher or iOS 12.0 or higher. In order to conclude a Sales Agreement, the Customer must have a valid/active e-mail address and, in certain cases, a keyboard or other pointing device that allows them to correctly fill in electronic forms.
IV. GOODS
1. Each Product presented for sale via the Online Store includes a sample photograph characteristic of its type and, in the appropriate tab, information about its properties, i.e.: colours and materials from which it is made, sizes, specific Product reference number.
2. Each Product presented for sale in the Online Store is the property of ESOTIQ, is brand new, free from physical and legal defects, and is approved for sale in the Republic of Poland.
3. An engraving on a personalised pin will not be made if its content is contrary to the law, good manners or infringes the personal rights of a third party.
4. The Goods presented in the photographs in the Online Store are examples of Goods of the same type and are presented in a manner closest to their actual appearance. The photographs reflect the colours and appearance of the Goods as accurately as possible. Due to individual settings or parameters of the user's monitor, there may be slight differences between the photograph and the actual colour of the Goods.
V. ACCEPTANCE AND PLACING OF ORDERS
1. Orders in the Online Store can be placed 24 hours a day, 7 days a week, exclusively via the website www.esotiq.com or the Esotiq mobile application.
2. Making a purchase in the Online Store via the website www.esotiq.com does not require the creation of a Customer Account, but it is necessary to provide basic data for contact and shipment of the Goods. Making a purchase in the Online Store via the Esotiq mobile application requires creating a Customer Account, and if you already have a Customer Account, logging in to your Customer Account via the Esotiq mobile application.
3. Placing an Order in the Online Store requires completing its individual stages. A Customer wishing to place an Order selects the type, model, colour, size and quantity of the available Goods at the price indicated in the Online Store. The selection is made via dialogue boxes on the Online Store website or via the Esotiq mobile application, in accordance with their functionality, including by clicking on the "add to basket" icon. If the Customer uses the Basket while logged into their Customer Account via the www.esotiq.com website, the contents of the Basket are synchronised with the Customer Account, which is then launched using the Esotiq mobile application (and vice versa). The Customer also selects the payment method. After selecting the Goods, providing the required data and payment method, the Customer sends the Order to Esotiq by clicking "CONFIRM PURCHASE". Sending a correctly completed Order is tantamount to submitting an offer to Esotiq to purchase the selected Goods in accordance with the Esotiq price list and to cover the costs of their delivery.
4. After placing the Order, the Customer will receive, via e-mail to the address provided by them, feedback confirming the acceptance of the Order, indicating the quantity, type and value of the Order and a unique Order number. The e-mail received by the Customer also confirms that the offer to purchase the Goods has been submitted correctly, has reached the ESOTIQ Online Store and has been accepted in accordance with the Terms and Conditions, and therefore a sales contract has been concluded. The information about the acceptance of the offer by Esotiq will contain confirmation of the conclusion of the contract, including the seller's name and address, the date of sale, the description of the Goods, their quantity, price and delivery costs.
5. At any stage of placing an Order, until it is sent, it can be cancelled by interrupting the ordering process by removing the previously added Goods from the basket.
6. A necessary condition for the performance of the sales contract via the Online Store is to provide the correct ordering entity, delivery address, number, telephone number and e-mail address. In the event of incorrect data, the ESOTIQ store reserves the right to contact the Customer.
7. The price lists of Goods in the Online Store are subject to change. The price of the Goods in accordance with the price list at the time of placing the Order by the Customer is binding for both the Customer and Esotiq.
8. The maximum value of Goods covered by a single cash on delivery Order may not exceed PLN 3,000 (three thousand zlotys).
VI. ONLINE STORE ACCOUNT
1. 1. Orders can also be placed and processed in the Online Store via the Customer Account. Furthermore, some of the Online Store's features can only be used via the Customer Account.
2. Customer registration in the Online Store, and thus the creation of a Customer Account, takes place by using the registration form and providing the following information:
a. E-mail address
b. Password
c. First name (optional)
3. Customers can also access their Account in the Online Store by activating their Account using their Google or Apple Account.
4. Registration is considered complete upon confirmation of registration after clicking on the activation link, which will be sent by Esotiq to the e-mail address provided in the registration form.
5. The Customer is solely responsible for the accuracy of the personal data provided. In addition, the Customer shall be responsible for keeping their Password confidential.
6. In order to use the Customer Account, the Customer must read these Terms and Conditions and accept them without any changes or reservations.
7. Upon acceptance of the Terms and Conditions by the Customer, a Customer Account Agreement is concluded between the Customer and Esotiq on the terms set out in these Terms and Conditions.
8. The Customer may terminate the Customer Account Agreement at any time, without giving any reason, by submitting a request to the following e-mail address: bok@esotiq.com.
9. The Customer also has the option of adding information necessary for the execution of Orders to the Customer Account, i.e. providing the Customer's personal data, including delivery address details and billing details, which will be automatically stored in the Esotiq IT system, together with data on previous transactions and the status of the current order, however, this involves providing Customer data, which will be stored in the ESOTIQ IT system.
10. For purposes related to the Customer Account Agreement, it is necessary for Esotiq to process personal data in accordance with the rules described in the Privacy Policy available at [WD1] .
VII. PRICES OF GOODS AND DELIVERY COSTS
1. The price of each Product presented in the Online Store is given in Polish zlotys and includes VAT, but does not include delivery costs.
2. Information on the total value of the order, including delivery costs, is presented in the Basket after the Customer has selected the payment method.
3. A detailed price list for delivery costs can be found at: https://esotiq.com/pl/pl/koszty-dostawy and in the Esotiq mobile app under: Account > Help and Contact.
4. Changes to the prices of Goods in the Online Store will not affect Orders already placed by the Customer and accepted by Esotiq.
5. Promotions in the Online Store cannot be combined unless the terms and conditions of a given promotion state otherwise.
VIII. PAYMENT METHODS
Customers of the Online Store may choose the following forms of payment for the ordered Goods:
1. PAYMENT CARD (including credit card) or ELECTRONIC TRANSFER. In this case, the Customer will be redirected to the Autopay.pl website, owned by Autopay S.A. with its registered office in Sopot at ul. Powstańców Warszawy 6, registered in the District Court Gdańsk - Północ in Gdańsk, 8th Commercial Division of the National Court Register under number 0000320590, with share capital of PLN 2,000,000 (paid in full), NIP: 585-13-51-185; entered in the register of payment service providers under number IP17/2013, in the register of lending institutions under number RIP000109, in the register of credit intermediaries under number RPK002057, and in the register of telecommunications entrepreneurs under number 11050.
2. Payment card via the First Data online payment system. The order is processed after the payment has been authorised in the operator's system. Transaction security is ensured by PCI DSS, SSL and 3D Secure technologies.
3. STANDARD BANK TRANSFER: choosing this payment method allows you to make the payment at any time, no later than 3 days from the date of placing the order. The order is processed after the payment is credited to the store's company account. After placing the order, you will receive an email with the bank account number to which the money should be transferred.
4. PAYMENT ON DELIVERY: payment for the Goods is made upon delivery - cash payment is made to the courier against a receipt. This form of payment is only possible if you choose DPD courier delivery.
5. The Customer cannot combine different forms of payment in a single Order.
6. The Order will be deemed invalid and the Sales Agreement will not come into effect in any case where:
a. The Customer has chosen to pay via autopay.pl and the transaction has not been authorised (accepted);
b. The Customer has chosen to pay by bank transfer and the payment has not been credited to Esotiq's account within 3 days of the Customer placing the Order;
c. The Customer has chosen cash on delivery and has not paid the courier upon delivery;
d. The Customer provided false contact details, preventing the proper performance of services.
IX. ORDER PROCESSING TIME AND DELIVERY
1. All accepted Orders are delivered to the Customer by the courier company DPD, the postal operator InPost S.A. or the courier company Orlen Paczka.
2. For each Product, in accordance with the functionality of the Online Store, the maximum order processing time by the Online Store is specified, with the specified time covering days from Monday to Friday. The order processing time varies depending on the selected payment method. The order processing period begins:
a. in the case of payment by PAYMENT CARD or ELECTRONIC TRANSFER - upon receipt by the ESOTIQ store of the Customer's payment authorisation in the Autopay system;
b. in the case of CASH ON DELIVERY - upon sending the e-mail referred to in Chapter V, point 4 of the Terms and Conditions;
c. in the case of payment by STANDARD BANK TRANSFER – upon the payment for the Order being credited to the ESOTIQ account.
3. One day should be added to the time of order fulfilment by the Online Shop for the delivery of the Goods.
4. All customers will be informed by e-mail about the current status of their order. Additionally, Customers who have a Customer Account will find information about their order in the MY ACCOUNT-Your orders tab at www.esotiq.com and in the Esotiq mobile application in the tab: Account > My Orders.
5. By default, the delivery address is the address provided by the Customer during registration in the Online Store.
6. When placing an Order, the Customer is entitled to indicate one of the Esotiq stores in Poland as the place of collection of the Goods, but only if they have not chosen cash on delivery as the form of payment for the ordered Goods (collection of goods at an Esotiq store is only possible if the following forms of payment are selected: payment card, electronic transfer, regular transfer). If the Customer chooses to collect the Goods at an ESOTIQ store, they will not be charged for the delivery of the Goods to the store, but they are obliged to go to the Esotiq store to collect the Goods in person, at their own expense. A list of current ESOTIQ stores where Goods can be collected is available at https://www.esotiq.com/salony When placing an Order (if the option of delivery of Goods to an ESOTIQ store is selected). The Customer is obliged to select the Esotiq store where they wish to collect the Goods, and the system will prevent the Order from being placed with the option of delivery to the store if the Customer has not selected a specific store as the place of delivery. After selecting the store to which the Goods are to be delivered, the Customer will not be able to change the method of delivery of the Goods or change the store to which the Goods are to be delivered, unless they cover the additional costs of shipping the Goods to another location. If the option of collecting the Goods at a store is selected, the Customer is required to present the Order number and provide the email address used in the purchase process to the salesperson (or other person issuing the Goods) in order to confirm their identity. The Customer acknowledges receipt of the Goods by signing the Goods receipt protocol or another document confirming receipt of the Goods. The seller (or another person issuing the Goods) will not release the Goods to a person whose details do not match those of the customer who placed the Order.
7. If the Customer receives the Goods in damaged packaging, it is recommended to describe this fact upon receipt of the parcel from the courier and report it to an ESOTIQ employee by e-mail to: reklamacje@esotiq.com. This point of the Terms and Conditions does not apply to sales with the option of collection at an Esotiq store – in this case, the Customer is obliged to inspect the Goods when collecting them at the Esotiq store, and the collection of the Goods by the Customer from the store is tantamount to the Customer confirming that the packaging and the Goods were not damaged (that they had no obvious defects).
8. In the event of unforeseen circumstances, Esotiq will inform the Customer about the problem and how to resolve it at the email address provided in the Order.
X. COMPLAINTS
1. Esotiq is liable for physical and legal defects of the Goods, in accordance with the applicable provisions, including the Act of 23 April 1964 Civil Code (Journal of Laws of 2014, item 121) and the Act of 30 May 2014 on consumer rights (Journal of Laws of 24 June 2014, item 827).
2. In particular, Esotiq is liable for physical defects in the Goods existing at the time of transfer of risk to the Customer or resulting from a cause inherent in the Goods sold at that time, consisting in the non-compliance of the Goods with the contract.
3. The Customer may use extrajudicial means of dealing with complaints and pursuing claims.
4. When submitting a complaint, the Customer may use the complaint form (click here).
5. In the event of a Complaint, Esotiq recommends returning the Goods in their original packaging, with the original proof of purchase and a description of the complaint, to the following address: Magazyn Esotiq, DC9, Wola Bykowska 35, 97-306 Grabica, with the note "REKLAMACJA ESOTIQ" (ESOTIQ COMPLAINT).
6. Instead of sending the Goods subject to complaint to the address given in the previous sentence, the Customer may choose to return the Goods subject to complaint to an Esotiq store in Poland. If this option is chosen, the Customer shall deliver the Goods subject to complaint to any ESOTIQ store in Poland. It is recommended to enclose the original proof of purchase and a description of the complaint.
7. The Online Store will consider complaints within 14 days of receiving the complaint.
8. If the complaint is accepted, the defective goods will be repaired or replaced with other, fully functional goods, at the Consumer's discretion. and if this is not possible (e.g. due to stock depletion) or would involve excessive costs, ESOTIQ will, in consultation with the Customer, refund the Customer the equivalent of the price of the Goods or reduce the price.
9. If the sale is made to the Customer as part of a transaction that does not meet the definition of consumer sale within the meaning of the acts specified in section 1 above, the complaint shall be considered in accordance with the relevant provisions of the Civil Code. In such a case, specific provisions regarding consumer protection shall not apply.

11. Complaints regarding the provision of electronic services (e.g. problems with account registration) should be reported to reklamacje@esotiq.com.
XI. WITHDRAWAL FROM THE AGREEMENT
1. Pursuant to Article 27 of the Act of 30 May 2014 on consumer rights (Journal of Laws of 24 June 2014, item 827), a Customer who is a consumer entering into a distance contract has the right to withdraw from the contract without giving any reason within 30 days of receiving the Goods and to immediately return the purchased Goods in an unchanged condition. The withdrawal statement should be sent to Esotiq at bok@esotiq.com
2. A Customer who wishes to withdraw from the contract has the right to use the following (CLICK) withdrawal form.
3. In the event of withdrawal from the contract, the Customer shall not bear any costs, except for the costs of returning the Goods to the Online Store.
4. The Customer is obliged to return the Goods immediately, no later than within 30 days from the date of receipt of the order, preferably together with a copy of the statement of withdrawal, to the address: Magazyn Esotiq, DC9, Wola Bykowska 35, 97-306 Grabica, with the note "ZWROT ESOTIQ" (ESOTIQ RETURN).
5. Exceeding the 30-day deadline for withdrawal from the contract will result in the withdrawal from the contract not being accepted.
6. The refund of the price, if paid, will be made in the manner specified in Chapter XI of the Terms and Conditions ("Refunds to customers").
7. The Consumer shall not have the right to withdraw from the contract in relation to a contract (pursuant to Article 38 of the Act of 30 May 2014 on consumer rights - consolidated text of 23 January 2019, Journal of Laws of 2019, item 134, as amended): a) in which the subject of the service is a non-prefabricated item, manufactured according to the consumer's specifications or serving to satisfy their individual needs; This means that there is no obligation to accept the return of goods made to the Consumer's order or modified at the Consumer's request, including products personalised with engraving or painting.
XII. REFUNDS TO CUSTOMERS
1. The Online Shop shall immediately refund the amount due in the event of:
a. cancellation of the Order or part of the Order (in which case the entire or part of the value of the Order shall be refunded) paid in advance before its execution;
b. return of the product as a result of withdrawal from the contract;
c. acceptance of a complaint and the inability to repair the damaged product or replace it with a new one, and the absence of further arrangements.
2. Esotiq shall refund the payment using the same method of payment as used by the Customer when purchasing the goods, unless the Customer has expressly agreed to a different method of refund which does not involve any costs for them.
3. The Online Store shall refund the payment within the time limits resulting from the mandatory provisions of law.
XIII. PERSONAL DATA
1. Personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 7 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.
2. The controller of personal data processed in connection with the use of the Online Store is ESOTIQ & HENDERSON S.A. with its registered office in Gdańsk, address: ul. Budowlanych 31C, 80-298 Gdańsk. Details regarding the protection of personal data are included in the Privacy Policy at https://esotiq.com/pl/en/privacy-policy, and in the Cookies Policy at https://esotiq.com/pl/en/cookies.
XIV. ESOTIQ MOBILE APPLICATION
1. Esotiq may enable the Customer to download the Esotiq Mobile Application free of charge to the Customer's mobile device from online stores with mobile applications, in particular:
a) Google Play / Play Store – for mobile devices with the Android operating system;
b) Apple App Store – for mobile devices with the iOS operating system. 2. The Customer's use of the Esotiq Mobile Application downloaded from a source other than those indicated in section 1 above involves the risk of compromising the integrity of the Esotiq Mobile Application and connecting to malicious software, which poses a threat to the security of the Customer's mobile device and the data stored therein.
3. In order to use the Esotiq Mobile Application, the Customer should:
a) read these Terms and Conditions and the information about the Esotiq Mobile Application provided in the online stores with mobile applications referred to in section 1 above;
b) download the Esotiq Mobile Application from one of the online mobile application stores referred to in section 1 above;
c) install the Esotiq Mobile Application on the Customer's mobile device, following the instructions displayed after starting the installation process or provided by the online mobile application store referred to in section 1 above.
4. The Esotiq Mobile Application connects to the Online Store via the Internet.
5. The Customer may uninstall (delete) the Esotiq Mobile Application from their mobile device at any time using the settings of that mobile device.
X V. CUSTOMER REVIEWS
- The Customer may publish their own Review of the Goods purchased in the Online Store free of charge. The Review may not concern the quality of customer service.
- The Customer may publish an Opinion only if they have purchased Goods in the Online Shop.
- After making a purchase in the Online Store, Esotiq customers may receive an invitation to post a Review at the e-mail address provided during the purchase process.
- In order to enable the submission of reviews, Esotiq uses TrustMate.io, an external tool for collecting Reviews. In connection with sending the invitation to submit a Review, the Customer's email address is transferred to TrustMate S.A. with its registered office in Wrocław (ul. Bartoszowicka 3, 51-641 Wrocław) (hereinafter "TrustMate"). Details on the processing of personal data can be found in Esotiq's privacy policy available at https://esotiq.com/pl/pl/polityka-prywatnosci and in TrustMate's privacy policy available at: https://trustmate.io./privacy-policy
- TrustMate sends the Customer an email asking them to submit a Review and providing a link to an online form for submitting it – the online form allows the Customer to answer Esotiq's questions about their purchases, rate them, add their own description of the Review and a photo of the purchased Goods. If no Review is submitted after receiving the first invitation to submit a review, TrustMate may resend the invitation once.
- Reviews submitted by the Customer are published by Esotiq in the Online Store, on Esotiq's websites, and on Esotiq's TrustMate.io profile, , to which the Customer gives their free consent.
- It is prohibited to enter into fictitious/sham sales contracts for the purpose of posting Reviews. Esotiq or its employees/associates, regardless of their formal basis of employment, may not be the authors of Reviews.
- Esotiq collects and publishes Customer Reviews for the following purposes in particular:
- To enable Esotiq and Customers to read other Customers' Opinions about a given Product;
- To develop and improve Esotiq's offer.
- If the Customer does not provide a nickname, the Review will be automatically published under the Customer's name. By submitting a Review, the Customer agrees to the publication of the nickname used by the author of the Review, or agrees to the publication of the Customer's name and its use by Esotiq in a manner regulated by the Terms and Conditions.
- Reviews may be published by the Seller in any promotional materials relating to the reviewed Goods, to which the Customer agrees by submitting a Review.
- The Customer may request the removal of their Review at any time.
- The Customer declares that they are the sole author of the Review and that the Review is true. The Customer declares that the Review does not violate the law or the rights of third parties (in particular copyright and personal rights, including reputation). The Customer is legally responsible for the content of their Review. The Review may not contain links, personal and contact details, photos or videos. The Review may not advertise other products and services, as the Review may only relate to the Goods purchased by the Customer.
- Esotiq may refuse to publish an Opinion or remove it if its content is contrary to the Terms and Conditions or generally applicable law.
- By submitting an Opinion, the Customer grants Esotiq a non-exclusive, royalty-free licence, unlimited in time and territory, to the Opinion, the rating given and the nickname as works, together with the right to sublicense them to third parties, including price comparison websites, social networking sites, and search engines in the following fields of exploitation: a) recording on all possible media; b) reproduction by any technique; c) distribution, in particular by way of public playback, display, exhibition, public sharing in any format in such a way that everyone can have access to them at a place and time of their choosing, including via the Internet, storage in a computer memory; d) marketing in Poland and abroad, lending, renting;
e) use of part or all, jointly and separately, for advertising and promotion or for information purposes, including in Esotiq brick-and-mortar stores; f) making modifications without violating the content of the Opinion and introducing changes required by the specific nature of the Internet and mobile devices, the right to use in various formats; g) the right to exercise and authorise the exercise of derivative copyrights in the fields of exploitation specified above. At the same time, by sending the Opinion, the Customer authorises Esotiq to exercise, on behalf of the Customer, their personal copyrights to the content of the Opinion and nickname.
XVI. FINAL PROVISIONS
1. The sales agreement is concluded between the Customer and Esotiq in Polish and is subject to Polish law. The relevant provisions of the agreement are recorded, secured and made available by sending the Customer an order confirmation in the form of an e-mail and a VAT invoice sent together with the Goods, which contains all the elements required by tax regulations, including the details of the seller and the buyer, the Goods, the price and the quantity of Goods purchased. Acceptance of these Terms and Conditions by the Customer who is also a consumer is tantamount to submitting a request for an invoice documenting the sale.
2. In order to use the services of the Online Store, the Customer is obliged to obtain access to the Internet and to use the equipment and software necessary to view websites.
3. These Terms and Conditions do not limit the rights granted to consumers by the legislation in force in the Republic of Poland.
4. All rights to the photos and video materials posted on the website www.esotiq.com are reserved by Esotiq. It is prohibited to use them in any field of exploitation.
